On August 6, 2025, the BC Supreme Court delivered its decision to dismiss the judicial review petition and interlocutory injunction application brought by Xatśūll First Nation regarding the Mount Polley tailings storage facility (TSF) raise.
Mount Polley has fully complied with all regulatory processes and voluntarily undertook not to deposit tailings into the raised portion of the TSF while the Court considered the matter.
The Court found that the Provincial Government approvals authorizing the TSF raise were reasonable and correct. It also confirmed that the consultation process with Indigenous Nations met the required legal standard. Mount Polley may continue depositing tailings into the TSF and may now commence using the raised section in accordance with existing permits.
