Mount Polley TSF – BC Supreme Court Reserves Judgement until August 6th

On June 30, 2025, the BC Supreme Court completed its hearing related to the judicial review petition and the interlocutory injunction application filed by Xatśūll First Nation.

Following the conclusion of the hearing, the Court advised that it expects it will issue its oral reasons for decision on August 6, 2025. The written reasons for decision follow at a later date.

In the interim, Mount Polley has provided a voluntary undertaking to the Court:

  • No tailings will be deposited into the newly-constructed raised section of the tailings storage facility until August 7.
  • Construction of the raise itself is continuing under valid permits issued by the Province of British Columbia.

Mount Polley remains committed to operating responsibly, in compliance with all regulatory requirements, and to maintaining respectful engagement with Indigenous Nations and local communities.
